Welcome to Fresh Food. By using the Mobile Food App and the services provided by it, you agree to the following terms and conditions, which constitute a legally binding agreement between you and the Food delivery service App (the “Agreement”).
All the food items listed on this application are freshly cooked and prepared in home kitchens. However, the food items are delivered by third-party vendors who are responsible for the delivery. We are not liable for any damages or losses arising from the delivery of food items.
- All payments for the food items should be made online using the payment gateway provided by the app. We are not responsible for any issues arising from the use of the payment gateway, including any losses or damages arising from the use of the payment gateway.
- It is the customer’s responsibility to ensure that they order the correct food item. Once an order has been placed, no changes or cancellations are permitted. Therefore, customers should carefully review their orders before submitting them.
- The delivery time may vary depending on the food items’ availability and location. We are not responsible for any delays caused by traffic, bad weather, or other factors beyond our control. We will make every effort to deliver the food items on time, but we do not guarantee the delivery time.
- The home cooks who prepare the food are solely responsible for the food’s quality. We do not take any responsibility for the food’s quality, taste, or appearance. If you have any issues with the food’s quality, please contact the home cook directly.
- The customer is solely responsible for any allergies or medical conditions. Please check the food items’ ingredients and allergens before placing your order. We do not take any responsibility for any health issues arising from the consumption of the food items.
- The customer should thoroughly check their order before accepting it. There will be no refunds for incorrect orders or orders that are accepted. However, if there are any issues with your order, please contact us within 24 hours of receiving the order.
- We reserve the right to use customer information in accordance with our Privacy Policy. By using this app, you agree to our Privacy Policy.
By using this app, you agree to all of the terms and conditions set forth in this Agreement. If you do not agree to these terms and conditions, please do not use this app. We reserve the right to update or modify these terms and conditions at any time without prior notice. Please check these terms and conditions periodically for changes.
Intellectual Property Rights:
All content on the Mobile Food App, including but not limited to, the text, graphics, logos, images, audio clips, and software, is the property of Fresh Food or its content suppliers and protected by Indian and international copyright laws. The compilation of all content on this site is the exclusive property of Fresh Food and protected by Indian and international copyright laws. You agree not to copy, reproduce, modify, distribute, display, perform, or create derivative works from any of the content on this site without the express written consent of Fresh Food or its content suppliers.
Limitation of Liability:
You understand and agree that the use of the Mobile Food App is at your own risk. Fresh Food and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the Mobile Food App, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if Fresh Food has been advised of the possibility of such damages. In no event shall Fresh Food or its affiliates be liable for any damages whatsoever resulting from the statements or conduct of any third party or the interruption, suspension, or termination of any services, whether such interruption, suspension, or termination was justified or not, negligent or intentional, inadvertent or advertent.
Indemnification:
You agree to indemnify, defend, and hold Fresh Food, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
Governing Law and Jurisdiction:
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You and Fresh Food agree to submit to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.
Termination:
Fresh Food may terminate this Agreement and your access to the Mobile Food App at any time, with or without notice, in its sole discretion, for any reason, including but not limited to, breach of these Terms and Conditions. Any suspected fraudulent, abusive or illegal activity may be grounds for termination of this Agreement and may be referred to appropriate law enforcement authorities.
Modification:
Fresh Food reserves the right to modify these Terms and Conditions at any time, and without prior notice, by posting amended Terms and Conditions on the Mobile Food App. Your continued use of the Mobile Food App indicates your acceptance of the amended Terms and Conditions.
Entire Agreement:
These Terms and Conditions constitute the entire agreement between you and Fresh Food and supersede all prior agreements or understandings, whether written or oral, relating to the use of the Mobile Food App.
Waiver:
The failure of Fresh Food to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
Severability:
If any provision of these Terms and Conditions is found to be invalid, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
